周林,法学博士,中国社科院法学所创新工程执行研究员(2012-2014)。1989-1994年曾在国家版权局工作,主持《著作权》杂志的编辑,并参与有关著作权法的立法调研工作。1994年进入中国社科院法学所,曾担任中国社科院知识产权中心副主任(1996-2000)、中国社科院法学所知识产权研究室副主任(2001-2010),曾应邀担任北京市第二中级人民法院人民陪审员(1995-1996)。
周林自1998年起担任国际法学会文化遗产法律委员会委员,2003年起担任中国国际经济贸易仲裁委员会域名争议解决中心仲裁员,自2010年起担任中国拍卖协会法律咨询委员会委员。周林还应邀在国家行政学院、中央美术学院、北京科技大学主持知识产权法、艺术法和信息法讲座,并曾应邀赴日本东京大学、英国伦敦大学、德国明斯特大学和萨尔大学主持研讨会及发表演讲。
周林自1994年起在中央美术学院讲授艺术法,自2006年起指导艺术法方向硕士研究生。周林在艺术法领域的主要著述有:《艺术法实用手册》(文集,主编)、《艺术法概要》(译著)。周林的主要出版物有:《信息自由与版权保护》(论文)、《中国版权史研究文献》(文件汇编,合编)、《知识产权案件的审理与裁判》(中、英、日文版专著,主编)、《知识产权研究》(系列书,第18-22卷,主编)。
周林爱好游泳、排球、远足、登山等,喜欢阅读小说、观看话剧、欣赏当代艺术,擅长水墨画和大画幅摄影,1994年成为中国美术家协会会员,1996年成为中国摄影家协会会员。
A short introduction of Prof. Dr. Zhou Lin
Zhou LinProfessor and Doctor of the Intellectual Property Center of China Academy of Social Sciences; Visiting Professor of Tokyo University (Japan) in 1996; Visiting Professor of the ITM of Muenster University (Germany) since 2000. Zhou Lin gave lectures on Copyright Law, Art Law and Information Law at several universities or institutes.
Prof. Dr. Zhou Lin used to work in National Copyright Administration of China (1989 to 1994), participating the draft of the very first Chinese Copyright Law, taking the position as a managing editor of Copyright a quarterly magazine published by Chinese Copyright Society. Prof. Dr. Zhou Lin moved to the Intellectual Property Center of China Academy of Social Sciences in March 1994. From then on he spent most of the time in the research work in IPR Law field. Zhou Lin is now in charge of a new project – Intellectual Property in An Information Society, funded by CASS.
From Oct. 5, Prof. Dr. Zhou will visit ITM for one month and doing research mainly in two aspects:
- A comparative study of the resale right. This is a topic in art law field. This right is old enough in Germany Copyright Law while it is now in the first stage of the draft in China. Both in favor and against such a right are sharing different stories. What should be the best choose and/or solution for the art market? What the Chinese policy makers should learn from Germany and Europe?
- A comparative study of the recent cases relating to the unfair competition in the Internet. A recent decision made in China that a defendant ISP should follow the private rule - robots.txt. A private agreement plays a key role in the decision. What next? In what degree that the private rules or agreements could influence the existing laws and regulations? What could be the properly react from the point of view of information law - information is free, but the freedom is not free.
Prof. Dr. Zhou Lin is a member of the Council of China Intellectual Property Law Society, a member of the Cultural Heritage Law Committee of International Law Association. He has published several articles on intellectual property, art law and information law in Britain, Germany, Japan and China. He has also published several books: An Introduction of China’s Copyright Law(chief editor), Art Law Handbook (chief editor), China Court Cases on Intellectual Property Rights (chief editor).
