He Tiantian
I. Basic Information
He Tiantian graduated from Renmin University of Chinawith a Ph.D.in International Lawin 2015. She is currently an assistant research fellow at CASS Institute of International Law and an editor of Chinese Review of International Law. Her research interests include international dispute settlement, international criminal law, international humanitarian law, and the law of the sea. She was awarded the title of one of the “100 Potential Young Scholars of Law”by Beijing Law Society in 2018.
II. Main Academic Viewpoints
In recent years, Dr. He has published several articles on the South China Sea ArbitrationCase and some procedural and evidence issues in international dispute resolution andexpressed the following views:
First, the South China Sea arbitral tribunal has no jurisdiction over the unilateral arbitration initiated by the Philippines. According to the awards, the arbitral tribunal improperly adopted and accepted the evidence provided by the Philippines. Second, with respect to procedural and evidentiary issues, the practice of international courts and tribunals has some similarities with the domestic ones while having its own characteristics. The evidentiary international practice is flexible, specific, and could be reviewed on a case-by-case basis.
