Article1Toensuretheself-governmentbyvillagersinthecountrysidesothattheycanadministertheirownaffairsbylaw,developgrassrootsdemocracyinthecountryside,protectthelegitimaterightsandinterestsofvillagersandfacilitatethebuildingofasocialistnewcountryside,thisLawhasbeenformulatedpursuanttotheConstitution.
Article2Avillagers’committeeisamassorganizationofself-governmentatthegrassrootslevel,inwhichvillagersadministertheirownaffairs,educatethemselvesandservetheirownneedsandinwhichelectionisconducted,decisionadopted,administrationmaintainedandsupervisionexercisedbydemocraticmeans.
Avillagers’committeeshallmanagethepublicaffairsandpublicwelfareundertakingsofthevillage,mediatedisputesamongvillagers,helpmaintainthepublicorder,andconveyvillagers’opinionsanddemandsandmakesuggestionstothepeople’sgovernment.
Avillagers’committeeshallberesponsibleandreporttothevillagers’assemblyorthevillagers’representatives’assembly.
Article3Villagers’committeesshallbeestablishedinlightoftheresidentialdistributionandpopulationsizeofvillagersandontheprincipleoffacilitatingself-governmentbythemass,economicdevelopmentandsocialmanagement.
Theestablishmentordissolutionofavillagers’committeeorareadjustmentintheareagovernedbyitshallbeproposedbythepeople’sgovernmentofatownship,aminorityethnictownshiporatownandsubmittedtothepeople’sgovernmentatthecountylevelforapprovalafteritisdiscussedandapprovedbythevillagers’assembly.
Avillagerscommitteemay,onthebasisoftheresidentialdistributionofvillagersandthecollectiveownershiprelationshipsofland,establishanumberofvillagers’groups.
Article4ThegrassrootsorganizationsoftheCommunistPartyofChinainthecountrysideshallworkinaccordancewiththeConstitutionoftheCommunistPartyofChina,playitsroleastheleadingcore,guideandsupportvillagers’committees’exerciseoffunctionsandpowers,and,undertheConstitutionandthelaw,providesupportandsecurityforvillagerstoconductself-governmentactivitiesanddirectlyexercisetheirdemocraticrights.
Article5Thepeople’sgovernmentofatownship,aminorityethnictownshiporatownshallguide,supportandhelpvillagers’committeesintheirwork,butmaynotinterferewiththeaffairsthatlawfullyfallwithinthescopeofself-governmentbyvillagers.
Villagers’committeesshallassisttheworkofthepeople’sgovernmentsofthetownships,minorityethnictownshipsandtowns.
ChapterIICompositionandDutiesofVillagers’Committees
Article6Avillagers’committeeiscomposedof3to7members,includingachairman,vice-chairman(vice-chairmen)andmembers.
Themembersofavillagers’committeeshallincludeatleastonefemale.Inavillagewherepeoplefrommorethanoneethnicgrouplive,theyshallincludeamemberormembersfromtheethnicgrouporgroupswithasmallerpopulation.
Membersofavillagers’committeemaybeprovidedwithappropriatesubsidies,ifnecessary.
Article7Avillagers’committeemay,whennecessary,establishsub-committeesforpeople’smediation,publicsecurity,publichealth,familyplanning,etc.Themembersofthevillagers’committeemayconcurrentlyserveasmembersofanysub-committee.Thevillagers’committeeinavillagewithasmallerpopulationmayassignmemberstoberespectivelyresponsibleforpeople’smediation,publicsecurity,publichealth,familyplanning,etc.insteadofestablishingsub-committees.
Article8Villagers’committeesshallencourageandorganizevillagerstodevelopvariousformsofcooperativeeconomiesandothereconomies,serveandcoordinatetheproductionoftheirvillages,andpromotetheproduction,constructionandeconomicdevelopmentinruralareas.
Avillagers’committeeshallmanagethelandandotherpropertyownedcollectivelybyfarmersofthevillage,andleadvillagerstorationallyutilizenaturalresourcesandtoprotectandimprovetheecologicalenvironment.
Avillagers’committeeshallrespectthedecision-makingpowerofthecollectiveeconomicorganizationsinconductingtheireconomicactivitiesindependentlyaccordingtolaw,safeguardthedualoperationsystemcharacterizedbythecombinationofcentralizedoperationwithdecentralizedoperationonthebasisofcontractualoperationbythehousehold,andensurethelawfulpropertyrightsandotherlawfulrightsandinterestsofthecollectiveeconomicorganizations,villagers,lease-holdinghouseholds,associatedhouseholds,andpartnerships.
Article9Villagers’committeesshallpublicizetheConstitution,laws,regulationsandstatepoliciesamongvillagers;educateandurgethemtofulfilltheirobligationsasprescribedbylawandtocherishpublicproperty,maintaintheirlawfulrightsandinterests,developcultureandeducation,popularizescientificandtechnologicalknowledge,enhancetheequalityofmenandwomen,doagoodjobinfamilyplanning,promotetheunityandmutualassistancebetweenvillages,andcarryoutvariousformsofactivitiesforthebuildingofthesocialistspiritualcivilization.
Villagers’committeesshallsupportthelawfulactivitiesofthesocialorganizationsbearingthenatureofservice,publicwelfareandmutualassistancesoastofacilitatecommunitybuildinginruralareas.
Inavillagewherepeoplefrommorethanoneethnicgrouplive,thevillagers’committeeshallhelpthevillagersunderstandtheimportanceofenhancingunity,mutualrespectandmutualassistanceamongdifferentethnicgroups,andgivethemguidanceinthisrespect.
Article10Avillagers’committeeanditsmembersshallobservetheConstitution,laws,regulationsandstatepolicies,abidebythevillagers’charterofself-governmentaswellasvillageregulationsandfolkconstitutionsandorganizetheimplementationthereof,andexecutethedecisionsorresolutionsofthevillagers’assemblyorvillagers’representativesassembly.Theyshallbeimpartialinhandlingaffairs,honestinperformingduties,warmheartedinservingvillagersandsubjecttothesupervisionofvillagers.
ChapterIIIElectionofVillagers’Committees
Article11Thechairman,vice-chairman(vice-chairmen)andmembersofavillagers’committeeshallbedirectlyelectedbyvillagers.Noorganizationorindividualmaydesignate,appointorreplaceanymemberofavillagers’committee.
Thetermofofficeofavillagers’committeeisthreeyears,andanewcommitteeshallbeelectedattheexpirationofthetermofofficewithoutdelay.Membersofavillagers’committeemaycontinuetoholdofficeifreelected.
Article12Electionofavillagers’committeeshallbeorganizedbyavillagers’electoralcommittee.
Avillagers’electoralcommitteeiscomposedofachairmanandmemberswhoshallbeelectedatthevillagers’assembly,thevillagers’representatives’assemblyorthevillagers’groupassembly.
Amemberofthevillagers’electoralcommitteeshallquitfromtheelectoralcommitteeifhe/sheisnominatedasacandidateforamemberofthevillagers’committee.
Whereavacancyappearsinthevillagers’electoralcommitteeasamemberquitsfromthecommitteeorduetoanyotherreason,thevacancyshallbefilledintheproperorderoftheoriginalelectionresults,oranotherelectioncanbeheld.
Article13Anyvillagerwhohasattainedtotheageof18shallhavetherighttoelectandstandforelection,regardlessofhis/herethnicstatus,race,sex,occupation,familybackground,religiousbelief,education,propertyandtimeofresidence,withtheexceptionofthosewhohavebeendeprivedofpoliticalrightsinaccordancewithlaw.
Beforeanelectionisheldforavillagers’committee,thefollowingpersonsshallberegisteredontherosterofvillagersparticipatingintheelection:
1.Villagerswhoseregisteredpermanentresidenceisinthevillageandwhoresideinthevillage;
2.Villagerswhodonotresideinthevillagealthoughtheirregisteredpermanentresidenceisinthevillagebuthaveexpressedthewilltoparticipateintheelection;and
3.Villagerswhohaveresidedinthevillageforoneyearormorealthoughtheirregisteredpermanentresidenceisnotinthevillage,haveappliedforparticipatingintheelection,andhavebeenapprovedbythevillagers’assemblyorvillagers’representativesassembly.
Avillagerwhohasalreadyregisteredforelectioninthevillagewherehis/herregisteredpermanentresidenceislocatedorwherehe/sheresidesmaynotparticipateintheelectionofthevillagers’committeeofanotherplace.
Article14Therosterofvillagersparticipatingintheelectionofavillagers’committeeshallbepublishedbythevillagers’electoralcommitteeatleast20dayspriortotheelectionday.
Anyonewhohasdemurtotherosterofvillagersparticipatingintheelectionmaymakeanappealtothevillagers’electoralcommitteewithin5daysaftertherosterispublished,andthevillagers’electoralcommitteeshallmakeahandlingdecisionandpublishthehandlingresultwithin3daysafterreceivingtheappeal.
Article15Fortheelectionofavillagerscommittee,candidatesshallbenominateddirectlybyvillagerswhohavebeenregisteredforelection.Whennominatingcandidates,villagersshallproceedfromtheinterestofallvillagersandselectthosewhorespectjustice,abidebythelaw,havegoodconduct,befairanddecent,bededicatedtothepublicwelfareundertakingandhavereceivedcertaineducationalandhasworkingability.Thenumberofcandidatesshallbelargerthanthenumberduetobeelected.Thevillagers’electoralcommitteeshallorganizecandidatestomeetwithvillagers,introducetheirplansforperformingdutiesafterholdingofficeandanswerthequestionsofvillagers.
Theelectionofavillagers’committeeshallbevalidifmorethanhalfofthevillagerswhohavebeenregisteredforelectioncasttheirvotes;acandidateshallbeelectedonlyifhe/shewinsmorethanhalfofthevotes.Ifthenumberofelectsislessthanthenumberduetobeelected,anotherelectionshallbeheldforthosevacancies.Inthatcase,amongpersonsnotelectedinthefirstelection,thosewithmorevotesshallbecandidates,andamongthesecandidates,thosewithmorevotesinthesecondelectionshallbeelected,providedthattheirvotesshallaccountforatleast1/3ofthetotalvotesthathavebeencast.
Theelectionshallbeconductedbysecretballotandopenvote-counting;theoutcomeoftheelectionshallbeannouncedonthespot.Duringtheelection,boothsshallbeinstalledforvoterstowritetheirballotsinprivate.
Whereanyvillagerparticipatingintheelectioncannotvoteduetoabsencemayauthorizeinwritingacloserelativeofhisorherswhohastherighttovoteinthevillagetovoteinhisorherstead.Boththeprincipalsandagentsshallbepublishedbythevillagers’electoralcommittee.
Specificelectoralmeasuresshallbeformulatedbythestandingcommitteesofthepeople’scongressesoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment.
Article16Agroupofatleast1/5ofthevillagerswhohavetherighttoelectoratleast1/3ofthevillagers’representativesmayproposetherecallofamemberofthevillagers’committee.Intheproposal,thereasonsforrecallshallbestated.Thememberofthevillagers’committeeproposedtoberemovedfromofficeshallhavetherighttopresentastatementinhisowndefense.
Aproposalfortherecallofamemberofthevillagers’committeeshallbeadoptedonlyifatleasthalfofthevillagerswhohavebeenregisteredforelectioncasttheirvotesandatleasthalfofvotersvoteforit.
Article17Ifapersoniselectedasamemberofavillagers’committeebyviolence,threatening,deceiving,bribing,forgingballots,falselyreportingthenumberofballotsorotherillegitimatemeans,his/herelectionshallbeinvalidated.
Ifaperson,byviolence,threatening,deceiving,bribing,forgingballots,falselyreportingthenumberofballotsoranyotherillegitimatemeans,hurdlesvillagers’exerciseoftherightstoelectandtostandforelectionandthusdisruptstheelectionofavillagers’committee,villagershavetherighttoreportagainsthimtothepeople’scongressandthepeople’sgovernmentofthetownship,minorityethnictownshiportown,ortothestandingcommitteeofthepeople’scongressandthepeople’sgovernmentatthecountylevelorthecompetentdepartmentthereof,andthepeople’sgovernmentatthetownshiporcountylevelshallberesponsibleforinvestigatingthematterandhandlingitinaccordancewithlaw.
Article18Theofficeofamemberofavillagers’committeewholosesthecapacityofconductorissentencedshallbeautomaticallyterminated.
Article19Aby-electioncanbeheldbythevillagers’assemblyorthevillagers’representatives’assemblyifthereisanyvacancyinthevillagers’committee.Theby-electionprocedureshallbeanalogicallygovernedbyArticle15ofthisLaw.Thetermofofficeofamemberelectedintheby-electionshallendalongwiththeexpirationofthetermofthevillagers’committee.
Article20Avillagers’committeeshallfinishthehandoverwithin10daysafteranewvillagers’committeeisformed.Thehandovershallbeorganizedbythevillagers’electoralcommitteeandsupervisedbythepeople’sgovernmentofthetownship,ethnictownshiportownconcerned.
ChapterIVVillagers’AssemblyandVillagers’RepresentativesAssembly
Article21Avillagers’assemblyiscomposedofvillagersatorabovetheageof18inthevillage.
Avillagers’assemblyshallbeconvenedbythevillagers’committee.Avillagers’assemblymustbeconvenedifitisproposedby1/10ofvillagersor1/3ofvillagerrepresentativesormore.Villagersshallbenotifiedatleast10daysbeforeasessionofthevillagers’assemblyisheld.
Article22Avillagers’assemblyshallbeconvenedwiththeparticipationofatleasthalfofthevillagersatorabovetheageof18oratleast2/3ofhouseholdsinthevillage,andeverydecisionmadebythevillagers’assemblyshallbeadoptedbyamajorityvoteofthevillagerspresent.Iftherearedifferentprovisionsontheconveningofvillagers’assembliesandtheirdecisions,suchprovisionsshallapply.
Ifnecessary,representativesofenterprises,institutionsandmassorganizationslocatedinthevillagemaybeinvitedtoobservethevillagers’assembly.
Article23Avillagers’assemblyshallreviewtheannualworkreportofthevillagers’committee,evaluatetheperformanceofthemembersofthevillagers’committee,andhavethepowertocancelormodifyanyinappropriatedecisionmadebythevillagers’committeeorthevillagers’representatives’assembly.
Avillagers’assemblymayauthorizethevillagers’representatives’assemblytoreviewtheannualworkreportofthevillagers’committee,toevaluatetheperformanceofthemembersofthevillagers’committeeandtocancelormodifyanyinappropriatedecisionmadebythevillagers’committee.
Article24Thefollowingmattersthatinvolvetheinterestsofthevillagersshallbedealtwithonlyuponthevillagers’assembly’sdecisionthroughdiscussion:
1.Thenumberofpersonswhoenjoysubsidiesforlossofworkingtimeinthevillageandtheratesforsuchsubsidies;
2.Theuseofproceedsfromthecollectiveeconomyofthevillage;
3.Proposalsfordevelopingpublicwelfareundertakings,raisingfunds,gatheringlaborforcesandcontractingconstructionprojectsinthevillage;
4.Landcontractingplans;
5.Proposalsontheinitiationandcontractingofcollectiveeconomyprojectsofthevillage;
6.Proposalsontheuseofresidentiallandlots;
7.Proposalsontheuseanddistributionofland-usecompensationfees;
8.Disposalofthecollectivepropertyofthevillagebylending,leasingoranyotherway;and
9.Othermattersinvolvingvillagers’interestswhichthevillagers’assemblybelievesshouldbedecidedbyitthroughdiscussion.
Avillagers’assemblymayauthorizethevillagers’representatives’assemblytodecideontheabove-mentionedmattersthroughdiscussion.
Iftherearedifferentprovisionsondecidingonmattersinvolvingthepropertyofthecollectiveeconomicorganizationsortheinterestsofthemembersthereofthroughdiscussion,suchprovisionsshallapply.
Article25Avillagewithalargerpopulationorwiththeinhabitantsscatteredhereandtheremaysetupavillagers’representatives’assemblytodecideonmattersthroughdiscussionupontheauthorizationthevillagers’assembly.Avillagers’representatives’assemblyshallbecomposedofmembersofthevillagers’committeeandvillagers’representatives.Villagers’representativesshallaccountforatleast4/5ofallpersonscomposingofthevillagers’representatives’assembly,andfemalerepresentativesshallaccountatleast1/3ofallmembersofthevillagers’representatives’assembly.
Villagers’representativesshallbeelectedbyvillagersontheprinciplethatevery5to15householdsrecommendingonerepresentative,orbeelectedbythevillagers’groups.Thetermofofficeforvillagers’representativesisthesameasthatforthevillagers’committee.Villagers’representativesmaycontinuetoholdofficeifreelected.
Villagers’representativesshallberesponsibletothehouseholdsorvillagers’groupsthatrecommendthemandbesubjecttothesupervisionofvillagers.
Article26Avillagers’representatives’assemblyshallbeconvenedbythevillagers’committeeatleastonceeveryquarter.Avillagers’representatives’assemblycanbecalledby1/5ofthevillagers’representativesormore.
Avillagers’representatives’assemblycanbeconvenedonlywiththeparticipationof2/3ofpersonscomposingofthevillagers’representatives’assembly,ormore,andeverydecisionmadebythevillagers’assemblyshallbeadoptedbyamajorityvoteofthepersonspresentattheassembly.
Article27Avillagers’assemblymaymakeandrevisethevillagers’charterofself-government,villageregulationsandfolkconventions,andsubmitthemtothepeople’sgovernmentofthetownship,ethnictownshiportownforarchivalpurposes.
Thevillagers’charterofself-government,villageregulations,folkconventionsanddecisionsmadebythevillagers’assemblyorthevillagers’representativesassemblymaynotconflictwiththeConstitution,laws,regulationsandstatepoliciesandmaynotcontainanyinformationinfringinguponthepersonalrights,democraticrightsandlawfulpropertyrightsofvillagers.
Ifthevillagers’charterofself-government,avillageregulationorfolkconvention,oradecisionmadebythevillagers’assemblyorthevillagers’representatives’assemblyviolatestheprecedingprovision,thepeople’sgovernmentofthetownship,ethnictownshiportownshallorderittocorrect.
Article28Avillagers’groupmeetingcanbeconvenedonlywiththeparticipationofatleast2/3ofvillagersatorabovetheageof18orhouseholdsofthevillagers’group,andeverydecisionshallbeadoptedbyamajorityvoteofpersonspresentatthemeeting.
Theleaderofavillagers’groupshallbeelectedatthevillagers’groupmeeting.Thetermofofficefortheleaderofavillagers’groupisthesameasthatforavillagers’committee.Theleaderofavillagers’groupmaycontinuetoholdofficeifreelected.
Theoperationandmanagementofland,enterprisesandotherpropertyownedcollectivelybyavillagers’groupandthehandlingofpublicwelfareundertakingsshallbedecidedbythevillagers’groupmeetingthroughdiscussionundertherelevantlaws.Anydecisionitmakesandtheimplementationthereofshallbedisclosedtovillagersofthegroupwithoutdelay.
ChapterVDemocraticManagementandDemocraticSupervision
Article29Villagers’Committeesshalladoptthedemocraticdecisionmechanismwherebytheminorityissubordinatetothemajority,applytheprincipleofconductingworkpubliclyandtransparently,andestablishandimprovevariouskindsofworkingsystems.
Article30Villagers’committeesshallapplythesystemofopenadministrationofvillageaffairs.
Avillagers’committeeshallacceptthesupervisionofvillagersbydisclosingthefollowingmatterswithoutdelay:
1.Mattersdecidedthroughdiscussionbythevillagers’assemblyorthevillagers’representativesassemblyasprescribedinArticle23or24ofthisLaw,andimplementationofthedecisions;
2.Plansforimplementingthestatepolicyforfamilyplanning;
3.Managementanduseoffundsandmaterialsappropriatedbythegovernmentordonatedbythepublicfordisasterrelieforaid;
4.Thevillagers’committee’sassistancetothegovernmentwork;and
5.Othermatterswhichinvolvetheinterestsofvillagersandareofgeneralconcernofvillagers.
Amongthoseasmentionedabove,generalmattersshallbedisclosedatleastonceeveryquarter;financialreceiptsandexpendituresshallbedisclosedatleastonceeverymonthifcollectivefinancialtransactionsarefrequent;andsignificantmattersinvolvingtheinterestsofvillagersshallbedisclosedatanytimewhentheyoccur.
Avillagers’committeeshallundertaketheauthenticityofthedisclosedmattersandaccepttheinquiryofvillagersaboutsuchmatters.
Article31Whereavillagers’committeefailstodisclosetherelevantmattersintimeordisclosesanyfalseinformation,villagershavetherighttoreportittothepeople’sgovernmentofthetownship,ethnictownshiportownorthepeople’sgovernmentatthecountylevelorthecompetentdepartmentthereof,whichshallinvestigateandverifythereportandorderthevillagers’committeetodisclosetherelevantinformationbylaw.Whereanyillegalactisverifiedastrue,theliablepersonshallbearresponsibility.
Article32Avillageshallsetupavillageaffairssupervisorycommitteeoravillageaffairssupervisoryorganinanyotherformtoberesponsibleforthefinancialmanagementofvillagersbydemocraticmeansandoverseetheimplementationofthevillageaffairsdisclosuresystemandotherrelevantsystems.Membersofsuchanorganshallbeelectedfromvillagersbythevillagers’assemblyorthevillagers’representativesassemblyandincludepersonswithaccountingandmanagementexpertise.Membersofavillagers’committeeandtheirnearrelativesmaynotbemembersofavillageaffairssupervisoryorgan.Membersofavillageaffairssupervisoryorganshallberesponsibletothevillagers’assemblyorthevillagers’representatives’assembly,andcanobservethemeetingsofthevillagers’committee.
Article33Membersofavillagers’committeeandemployeeswhosesubsidyforlossofworkingtimeshouldbecollectivelypaidbyvillagersorthevillageshallbesubjecttothedemocraticappraisalofthevillagers’assemblyorthevillagers’representatives’assemblyontheirperformanceofduties.Democraticappraisalshallbeconductedatleastonceeveryyearandhostedbythevillageaffairssupervisoryorgan.
Whereanymemberofavillagers’committeeisconsecutivelydeterminedasincompetenttwice,his/herofficeshallbeterminated.
Article34Villagers’committeesandvillageaffairssupervisoryorgansshallsetupvillageaffairsfiles.Suchfilesinclude:electiondocumentsandvotes,minutes,landcontract-issuingplansandcontracts,economiccontracts,collectivefinancialaccounts,collectiveassetsregistrationdocuments,basicdataaboutpublicwelfareestablishments,capitalconstructiondata,residentiallandlotplans,land-usecompensationfeeuseanddistributionplans,etc.Villageaffairsfilesshallbeauthentic,accurate,integratedandstandard.
Article35Theincumbentmembersofavillagers’committeeandthosewhoseofficeexpiresshallbesubjecttoeconomicresponsibilityaudit.Matterssubjecttoauditinclude:
1.Thefinancialreceiptsandexpendituresofthevillage;
2.Thecreditor’srightsanddebtsofthevillage;
3.Themanagementanduseoffundsandgoodsappropriatedbythegovernmentanddonatedbythegeneralpublic;
4.Themanagementoftheissuingofcontractsontheproduction,operationandconstructionprojectsofthevillageandthebiddingsituationsofpublicwelfareestablishmentconstructionprojects;
5.Themanagementanduseoffunds,thecontracting,lease,guaranteeandassignmentofcollectiveassetsorresources,andtheuseanddistributionofland-usecompensationfeesinthevillage;and
6.Othermattersthatneedtobeauditedupontherequestof1/5ormoreofvillagers.
Theeconomicresponsibilityauditofincumbentmembersofavillagers’committeeandthosewhoseofficeexpiresshallbeorganizedbytheagriculturaldepartmentorfinancialdepartmentofthepeople’sgovernmentatthecountylevelorthepeople’sgovernmentofatownship,ethnictownshiportown.Theauditresultsshallbemadepublic.Inparticular,theeconomicresponsibilityauditresultsofthosewhoofficeexpiresshallbemadepublicbeforetheelectionofthenextvillagers’committee.
Article36Whereavillagers’committeeoranymemberthereofmakesadecisioninfringinguponthelegitimaterightsandinterestsofanyvillager,thevillagermayapplytothepeople’scourtforrescindingthedecisionandsubjectingtheliablepersontolegalresponsibility.
Whereavillagers’committeefailstofulfillthestatutoryobligationspursuanttolawsandregulations,thepeople’sgovernmentofthetownship,ethnictownshiportownshallorderittocorrect.
Wherethepeople’sgovernmentofatownship,ethnictownshiportowninterfereswithanyoftheaffairsthatlawfullyfallwithinthescopeofself-governmentbyvillagers,thepeople’sgovernmentatthenexthigherlevelshallorderittocorrect.
ChapterVISupplementaryProvisions
Article37Thepeople’sgovernmentsshallprovidethenecessaryconditionsforvillagers’committeestoassistthegovernmentwork.Expensesnecessaryforvillagers’committeestoaccomplishthetasksassignedbytherelevantdepartmentsofthepeople’sgovernmentsshallbepaidbythedepartmentswhichassignthetasks.
Expensesneededbyavillagers’committeeforthepublicwelfareundertakingofthevillageshallbeprovidedbythevillagers’assemblywiththefundspaidbythevillagersorwiththelaborprovidedbythevillagers.Whereitisreallydifficulttocoversuchexpenses,thelocalpeople’sgovernmentmayprovideproperfinancialsupport.
Article38Governmentdepartments,publicorganizations,unitsofthearmedforces,state-ownedorstateholdingenterprisesandinstitutions,andpublicinstitutions,whicharelocatedinthecountryside,aswellastheirworkersshallnotjointhevillagers’committees,butshallparticipateinthecommunitybuildingofruralareasinvariousformsandabidebytherelevantvillageregulationsandfolkconstitutions.
Whenthevillagers’committees,villagers’assembliesorvillagers’representatives’assembliesofvillageswheretheseunitsarelocateddiscussanddealwiththeproblemsinwhichtheyareinvolved,theyshallconsultwiththem.
Article39Thelocalpeople’scongressesatalllevelsandthestandingcommitteesofthelocalpeople’scongressesatorabovethecountylevelshallguaranteetheimplementationofthisLawwithintheiradministrativeregionsandguaranteevillagers’exerciseoftheirself-governmentrightinaccordancewithlaw.
Article40Thestandingcommitteesofthepeople’scongressesofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmay,inaccordancewiththisLawandinlightoftheactualconditionsintheirrespectiveadministrativeregions,formulatemeasuresfortheimplementationofthisLaw.
Article41ThisLawshallcomeintoforceonthedateofpromulgation.
