Since the adoption of the Property Law, the scientific theory of registration of real estate, based on the legal mechanism of the marketization of real estate, has gradually gained general acceptance in China. Not only our general recommendations on the registration of real estate have been embodied in the Basic Principles of the Property Law, but also the two main government departments responsible for the registration of real estate, departments of land administration and departments of administration of real estate construction, have quickly abolished multi-level registration system and realized the internal unification of the level of registration of real estate within their respective system, thereby partially clearing up the chaos in the field of real estate registration.
Vigorously promoted by the new Chinese leadership since 2013, the unified real estate registration system, provided for in Article 10 of the Chinese Property Law, will soon be established. This system is of great significance to the national economy and the people's livelihood and will certainly play an important role in the political and economic development as well as in the protection of citizens' rights in China.
Just before the establishment of the legal system of real estate registration, for which we have made near 20 years efforts, we were commissioned by the Ministry of Land and Resources to prepare a recommended draft of the Regulations on Real Estate Registration. The Drafting Group was established smoothly and the drafting work proceeded rapidly because we had already made ample theoretical preparation for this work. Support by the relevant departments under Ministry of Land and Resources and the State Council, we have also carried out a series of investigation work on the relevant issues. The recommended draft contained in this book mainly reflects the views of legal scholars and is intended to be used as reference by and to solicit opinions from all people of insight.
