Chen Jie (ed.), Chinese Commercial Law: Interpretation and Application, Beijing: Social Sciences Academic Press, 2013.
The contradiction between the activeness of commercial phenomena and the inertia of commercial legislation has determined the arduousness of the interpretative research in the field of commercial law. Especially after the formation of the socialist legal system in China, correct understanding and effective implementation of laws has become the priority among priorities in the construction of the commercial legal system in the country. This book, taking the interpretative mechanism as its starting point, attaches equal importance to the method of interpretation of commercial law, the commercial law interpretation of concrete commercial system, as well as the reflections on and revisions of the results of the existing interpretations of commercial law, and strives to offer effective plans of or approaches to the transformation of the norms in the legal texts of commercial law into legal orders by organically combining the mechanisms of commercial practice with mechanisms of the operation of the rule of law.
