
On October 28, 2017, the Seminar on the Drafting of the Book on Marriage and Family in Chinese Civil Code, jointly organized by the Marriage Law Research Committee of China Law Society and the Institute for Human Rights of China University of Political Science and Law, was held in Beijing. The seminar was attended by about a dozen experts and scholars, including Professor Chen Mingxia, a research fellow at CASS law Institute and an advisor to the Marriage Law Research Committee of China Law Society, and persons in charge of various subprojects on the Book on Family and Marriage in the Civil Code and on various chapters in the book. At the seminar, Professor Xia Yinlan, the Chairwoman of the Marriage Law Research Committee of China Law Society and person in charge of the project, gave a brief introduction to the background of the seminar, transmitted the instructions and demands of China Law Society regarding the submission of opinions on the revision of the Draft Book on Marriage and Family in the Chinese Civil Code prepared by the Legislative Affairs Commission of under the NPC Standing Committee (“the indoor draft”), and the objective of continuing to strengthen the study on the Book on Marriage and Family in the Chinese Civil Code and contributing academic wisdom to the codification of the civil law in China. The participants of the seminar analyzed the “indoor draft” in light of the Expert Proposal on the Draft Book on Marriage and Family in the Chinese Civil Code, and after repeated discussion and demonstration, put forward suggestions on the further revision of the “indoor draft” with respect to its layout, legislative guideline, and concrete content. Finally, Professor Long Yifei, a standing vice chairman of the Research Committee and the person in charge of the project, summarized the result of the seminar and put forward a concrete plan for the work of the Research Committee at the next stage. After the seminar, the Project Team will prepare a report on the revision of the “indoor draft” on the basis of the opinions put forward in the seminar and submit it to China Law Society in accordance with the timetable determined by the Research Committee.
