On May 16, 2016, the Supreme People’s Court and the Supreme People’s Procuratorate simultaneously issued circulars requiring people’s courts and people’s procuratorates at various levels throughout the country to implement the new standard of state compensation. According to the circular of the Supreme People’s Court, beginning from May 16, 2016, the standard of state compensation for violation of citizen’s personal freedom shall be 242.3 yuan per day, 22.58 yuan more than the standard in the last year. Actually, this standard has been rising every year since 2007. Recently the newspaper Legal Daily interviewed a number of legal experts, including Professor Mo Jihong, Deputy Director of CASS Law Institute, on the significance of this rise in the standard of state compensation. In the interview, Professor Mo pointed out that this dynamic adjustment of the standard of state compensation is decided not arbitrarily by some state leaders, but in strict accordance with the State Compensation Law, which provides in Article 33 that: “If freedom of the person of a citizen is infringed, compensatory payment for each day shall be assessed in accordance with the State average daily pay of staff and workers in the previous year.” The continuous rise in the standard of state compensation reflects the rise in average daily wage of the staff and workers in the previous year, the level of social and economic development and the increase in people living cost. Such dynamic adjustment of standard of state compensation is more fitting to the social reality in China and conducive to upholding justice and fairness.
