UNIDROIT-FAO-IFAD Legal Guide on Agricultural Land Investment Contracts and Agricultural Land Rights in China

Abstract: The International Institute for the Unification of Private Law launched the

“UNIDROIT-FAO-IFAD Legal Guide on Agricultural Land Investment Contracts (Zero Draft )” (ALIC) in June 2019, which aims to provide guidance on legal issues involved in the investment of agricultural land. China, as a big agricultural country, its agricultural land development is related to the food security. At present, the foreign direct investment in agricultural land is not allowed. However, under the background of the “three rights division” (land ownership, contracting right, management right) of the agricultural land, how to promote the management right of land is the main issue. ALIC reflects a more comprehensive legal arrangements, and provides the predictability for legal risks, and it will be the reference for China and other countries. China should pay attention to ALIC and make precautions in agricultural land investment.
