The seminar on the Positive Incentive Mechanism for the Voluntary Performance of Judicial Judgments and the Credit Restoration Mechanism, jointly sponsored CASS Law Institute, the Intermediate People’s Court of Ningbo Municipality and the Development and Reform Commission of Ningbo Municipality and organized by the CASS Center for National Index of Rule of Law, was held in Ningbo City of Zhejiang Province on August 15, 2020. At the seminar, first an introduction was given to the background, practice and results of the implementation of the positive incentive mechanism for voluntary performance and the credit restoration mechanism in Zhejiang Province. Then participants gave speeches and carried out discussion on a wide range of issues relating to the theme of the seminar. Professor Chen Su, a member of the Academic Committee of CASS and the director of CASS Law Institute, gave keynote speech entitled “organically combining ethicality and scientificity in the improvement of the credit mechanism”. In the speech, he pointed out that the mechanism has important theoretical and practical significance because it is practical, innovative, effective, upgraded and replicable. Professor Tian He, Director of CASS Center for National Index of Rule of Law, pointed out in her speech “several issues to be paid attention to in the restoration of credit” that credit restoration should be more refined and be carried through to the end. Attention should be paid to striking a balance between the reform and institutional stability, to correctly handling of the relations between the dishonesty list and local business environment, between good faith enforcement and compulsory enforcement, between the flexibility and the standardization of institutions and between integration of trial and enforcement and credit restoration, and to incorporating credit restoration into the social credit system.
Professor Chen Su and Professor Tian He: Exploring the Construction of the Credit System by Innovating the Enforcement Mechanism
