Professor Sun Xianzhong, a member of the Constitution and Law Committee of the National People’s Congress, a member of the Academic Committee of CASS, and a member of the Academic Committee of China Law Society, was invited by the Information Office of the State Council to attend a briefing on the newly adopted Chinese Civil Code on July 31, 2020. At the briefing, Professor Sun introduced the Chinese Civil Code and the situation of its implementation and answered the questions raised by reporters. In the introduction, he stressed the great significance of the adoption of the Chinese Civil Code, pointing out that the mission of the Civil Code is not only to guarantee the rights of citizens, but also to realize state governance. For example, in the Book of Property Right, the Civil Code, by providing an institutional safeguard for the protection of state and public properties, improves the legal support for the economic basis of the state and establishes a clear, lawful and appropriate order of public property. He gave detailed introductions to the significances, the main contents and the technical and institutional innovations of the books on the property law, marriage and family law, and inheritance law. After the introduction, Professor Sun answered a series of questions raise by reporters, including those concerning the reasons for a separate book on personality rights in the civil code, the provision on the term of the right to use land for construction for dwelling houses, the review and abolition of separate civil laws after the adoption of the Civil Code, the significance of the punitive damages for the infringement upon intellectual property right, the provisions on sexual harassment in the Civil Code, the inheritance of parents’ housing property by the only child, and the so-called “zombie clauses” in the Civil Code.
