Professor Liao Fan Interviewed by CGTN on the National Security Legislation for Hong Kong (II)

 

On May 22, 2020, Professor Liao Fan, a research fellow and the head of Department of Research Coordination and International Cooperation of CASS Institute of International Law, was interviewed by the China Global TV Network (CGTN) special program on “the Two Session (NPC & CPPCC)” on draft decision on establishing and improving the legal system and enforcement mechanisms for the Hong Kong Special Administrative Region (HKSAR) to safeguard national security. In the interview, Professor Liao pointed out thatthe significance of this decision lies in the following three aspects: firstly, the decision is very necessary. One of the important reasons for current chaotic situation in Hong Kong is that the Government of Hong Kong SAR has,for a long period of time, failed to adopted a national security legislation in accordance with Article 23 of the Basic Law.Under this situation, it is necessary for the National People’s Congress to make arrangement at the national level for the legislation on the national security legislation in Hong Kong.Secondly, the decision is totally legitimate. According to the Chinese Constitution, the National People’s Congress, as the highest legislative organ in China, has the power to decide on the establishment of SARs and various systems in SARs. Thirdly, the decision has received wide support.Hong Kong and Macao Affairs Office of the State Council, the Liaison office of China's Central Gov't in Hong Kong SAR, and the Chief Executive of the Hong Kong Special Administrative Region, Mrs. Carrie Lam, all expressed their support to the decision immediately after it was adopted. The decision has shown the determination of the Central Government to uphold the “One Country, Two System” and safeguard the prosperity and stability in Hong Kong. By filling up a legal gap in national security in Hong Kong SAR, the decision is conducive to ensuring the implementation of the “One Country, Two System” in Hong Kong.
