The Study of Marriage and Family Law in the New China

Abstract: To provide theoretical support and countermeasures for legislation is one of the features of the research on Chinese marriage and family law． Three issues have been paid much more attention to by Chinese academic circles since the Marriage Law of 1950， which are the relationship between marriage and family law and civil law， the structure of matrimonial property， and the standard of referee’s divorce． In the future， the challenges and opportunities on the studies will coexist． The comprehensive immersion of civil law thinking and research paradigms will be an inevitable trend． At the same time， the research on marriage and family law should respond positively to new phenomena and problems in the process of social progress and development．
