The Sixth Lecture of the Legal Innovation Forum in 2019: Issues relating to the Extraterritorial Application of Law Held at CASS Institute of International Law

 

The Sixth Lecture of the Legal Innovation Forum of CASS Law Institute and CASS Institute of International Law in 2019 was successfully held at the conference room of the two institutes on November 19, 2019. At the forum Professor Shen Jun, a Research Fellow at the International Private Law Department of CASS Institute of International Law, gave a lecture entitled “Issues relating to the Extraterritorial Application of Law”. The lecture was presided over by Professor Qu Xiangfei, a research fellow at CASS Institute of International Law. Professor Li Qingming, an associate research fellow at CASS Institute of International Law, served as the commentator at the lecture. In the lecture, Professor Shen defined the basic meaning of “the application of law”, distinguished the three different situations of “application of domestic law to foreigners”, explored the extraterritorial application of public and private law, analyzed the US practice in the Meng Wanzhou Case, and finally pointed out that the extraterritorial application of law is a passive application determined by the setup of conflict norms and connection points of a country. After the lecture, Professor Li Qingming and other scholars from the two institutes made comments and carried out discussions on issues discussed in the lecture and Professor Mo Jihong, Director of CASS Institute of International Law, gave a summarization of the lecture.
