This book explains the legal attributes of collective fund trust plansthroughthe following four steps: firstly,it analyzes the nature of legal relations involved in collective fund trust plans, stressing its differences from such systems as trust and agency, and demonstrating its unique institutional structure in such dimensions as historical development, theoretical basis, and economic functions; secondly, itcarries out research on the characteristics of the financial products of collective fund trust plans and, under the precondition of assuming them as “private financial investment commodities”, analyzessuch issues as the screening of “qualified investors” and the protection of their rights and interests; thirdly, it explores the business organizational characteristics of collective fund trust plans, and examines the governance mechanism and the unique asset structure under collective fund trust plans; and finallyit analyzes the financing characteristics of collective fund trust plans, giving prominence to their differences and distinctions from the relevant businesses of such financial institutions as banks, insurance companies and securities companies, and explores the question of how the existing regulatory system regulate trust companies and their relevant businesses.
